
ArmInfo. Armenian authorities want to regulate issues related to illegal construction. During an extraordinary session of the National Assembly of the Republic of Armenia, amendments to the Civil Code and a package of accompanying bills are being discussed in the first reading.
Presenting the document, Deputy Head of the Cadastre Committee Nane Ghazaryan explained that amendments made to the Civil Code in 2021 established a specific deadline for registering and applying for the legalization of structures built before those amendments. At that time, it was also stipulated that any unauthorized construction occurring after the 2021 legislative changes would no longer be eligible for legalization. The current proposed amendments aim to resolve practical challenges that have since emerged by expanding the legal framework for legalization while simultaneously implementing stricter requirements.
The deadline for legalizing unauthorized structures will be set until December 30, 2027. At the same time, the necessary conditions for inclusion on the government-approved list of illegal structures subject to legalization will be established, including a positive opinion issued by an individual or organization holding the appropriate license and documentation, a preliminary assessment by a competent authority, and payment of the established local legalization fee.
The draft also proposes establishing new types of local fees for the legalization of illegal structures. According to the draft, if illegal buildings in Yerevan and surrounding areas are legalized, a three-fold legal fee will be charged for document processing, as well as a one-time local fee of 100 million drams. In districts and communities not adjacent to Yerevan, the same fee will be 50 million drams.
