
ArmInfo. In Armenia, members of local councils of elders will have the right to withdraw their resignations within three days of submitting them. At its February 5 meeting, the National Assembly Committee on Territorial Administration, Local Self-Government, Agriculture, and Environmental Protection approved amendments to the laws "On Local Self-Government" and "On Local Self-Government in Yerevan" submitted by committee chair Vahe Ghalumyan.
According to the author of the legislative initiative, Article 26 of the Law "On Local Self-Government" establishes provisions regarding the early termination of the powers of a community head. Section 3.1 of the same article stipulates that a community head may withdraw their resignation within three days. Meanwhile, Article 70 of the same law establishes provisions regarding the early termination of the powers of a Council of Elders member, but does not legally regulate the possibility of withdrawing their resignation.
By the same token, as Galumyan noted, Article 20 of the Law "On Local Self-Government in the City of Yerevan" establishes provisions regarding the early termination of a member of the Yerevan Council of Elders and does not provide for the possibility of withdrawing a resignation letter from a Council of Elders member.
Article 155 of the constitutional law "Rules of Procedure of the National Assembly" establishes the procedure for the resignation of a member of parliament.
In particular, Part 2 of the same article defines the procedure for withdrawing a resignation letter from a member of parliament. The positions of community head, National Assembly deputy, and Council of Elders member are elected public offices. Based on the general principle of law, if a community head and National Assembly deputy have the right to withdraw a resignation letter after it has been submitted, then a Council of Elders member should also have the same right and opportunity. The proposed amendments to the current laws will give them this opportunity, thereby eliminating a gap in the country's current legislation.
