ArmInfo.The UN International Court of Justice granted almost all the provisional measures requested by Armenia against Azerbaijan, and rejected the majority of Azerbaijan's requested measures. RA Permanent Representative before the ECHR Yeghishe Kirakosyan announced this on his Twitter page.
"Armenia welcomes the orders and looks forward to their practical implementation by Azerbaijan and its high ranking officials," he stressed.
To note, yesterday, the International Court of Justice in The Hague issued a ruling on the Application of the International Convention on the Elimination of All Forms of Racial Discrimination (Armenia v. Azerbaijan).
The Court reportedly ordered: "The Republic of Azerbaijan shall, in accordance with its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination, Protect from violence and bodily harm all persons captured in relation to the 2020 Conflict who remain in detention, and ensure their security and equality before the law; Take all necessary measures to prevent the incitement and promotion of racial hatred and discrimination, including by its officials and public institutions, targeted at persons of Armenian national or ethnic origin; Take all necessary measures to prevent and punish acts of vandalism and desecration affecting Armenian cultural heritage, including but not limited to churches and other places of worship, monuments, landmarks, cemeteries and artefacts; Both Parties shall refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve."
It is reported that the Court has not yet ruled on Azerbaijan's counterclaim on violations of the same UN anti-discrimination treaty. In the case "Azerbaijan v. Armenia".
The court ordered: "The Republic of Armenia shall, in accordance with its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination, take all necessary measures to prevent the incitement and promotion of racial hatred, including by organizations and private persons in its territory, targeted at persons of Azerbaijani national or ethnic origin; Both Parties shall refrain from any action which might aggravate or extend the dispute before the Court or make it more difficult to resolve."
To recall, On 16 September 2021, the Republic of Armenia (hereinafter "Armenia") filed in the Registry of the Court an Application instituting proceedings against the Republic of Azerbaijan (hereinafter "Azerbaijan") concerning alleged violations of the International Convention on the Elimination of All Forms of Racial Discrimination of 21 December 1965 (hereinafter "CERD" or the "Convention").
In its Application, the Armenian side emphasized that for decades Azerbaijan has subjected the Armenian people to racial discrimination, and that as a result of the state-sponsored hate policy towards the Armenians, the latter have been subjected to massacres, torture and other crimes. In addition, the Application stated that these violations again came to the fore during the conflict initiated by the Azerbaijani side in September 2020, which once again grossly violated the Convention (CERD). Even after the end of hostilities, the ceasefire, which entered into force on November 10, 2020, Azerbaijan continued to carry out killings, torture and other crimes against Armenian prisoners of war, hostages and other detainees. The statement indicates that Azerbaijan is responsible for the violation of the Convention, including Articles 2, 3, 4, 5, 6 and 7.
