The Court of General Jurisdiction of the city of Yerevan decided to terminate the criminal prosecution in accordance with Article 300.1 of the RA Criminal Code (Overthrow of the Constitutional System) against the 2nd President of Armenia Robert Kocharian. In addition, the charges were dropped against former CSTO Secretary General Yuri Khachaturov and former Defense Minister Seyran Ohanyan. The measure of restraint chosen in relation to the latter was canceled, their property was released from custody.
However, Robert Kocharian and Armen Gevorgyan, who was the head of the presidential staff in 2008, is still involved in the criminal case on accepting a bribe on an especially large scale. It should be reminded that at the end of March, the Constitutional Court of Armenia declared Article 300.1 of the RA Criminal Code unconstitutional, on the basis of which charges were brought against the second president, Robert Kocharian.
The court ruled that Article 300.1 of the RA Criminal Code does not correspond to the Constitution of Armenia. Earlier, Robert Kocharian applied to the Constitutional Court with a request to establish the legality of the charges brought against him. Kocharian and others are charged under Article 300.1 of the Armenian Criminal Code (overthrow of the constitutional order). Article 300.1 of the Criminal Code of Armenia was recognized as contradicting Articles 78 and 79 of the Constitution of Armenia.
