ArmInfo.The Standing Committee on State and Legal Affairs gave a positive conclusion on the initiative of the "My Step" bloc to appeal to the Constitutional Court to terminate the powers of the Chairman of the Constitutional Court Hrayr Tovmasyan.
To note, the parliament will be able to make a decision on appealing to the Constitutional Court only after discussing the issue by secret ballot with a 3/5 vote ratio. However, the final decision will be made by the Constitutional Court itself . This requires the votes of at least six judges.
The Bright Armenia faction supported this initiative, while the MP from the Prosperous Armenia party Naira Zohrabyan stated that the faction would hold a meeting and express its position on this issue.
To note, on September 19, the ruling bloc introduced into the circulation of the National Assembly a draft appeal to the Constitutional Court regarding the termination of the powers of the Chairman of the Constitutional Court Hrayr Tovmasyan.
To recall, the reason for the termination of the powers of the head of the Constitutional Court was the decision adopted by the Armenian Constitutional Court on September 4 on the suit of the defense of the second President of the Republic of Armenia Robert Kocharian. In particular, Article 35 of the RA Criminal Code is recognized as unconstitutional, since it does not provide for the functional inviolability of officials endowed with special protection by the force of the Constitution, among the circumstances excluding criminal proceedings or criminal prosecution. "This article is found to be contrary to paragraph 4 of part 1 of article 27, part 1 of article 61, part 1 of article 63, articles 75 of the Constitution," the Constitutional Court said. On the second appeal of Kocharyan's defense on the review of compliance with the Constitution of Part 2 of Article 135 of the Criminal Procedure Code of the Republic of Armenia, the Constitutional Court recognized it as complying with the main law of the country. Thus, the Constitutional Court ruled that the verdicts adopted by it, in accordance with part 2 of Article 179 of the Constitution, are final and come into force from the moment they are published.
It should be noted that Robert Kocharyan was arrested on charges of overthrowing the constitutional order in 2008.
