


ArmInfo. The European Court for Human Rights (ECHR) ruled in the case of Garik Dadayan, who was convicted of facilitating and inciting the smuggling of enriched uranium to Georgia.
According to the ECHR verdict, there has been a violation of Article 6 of the Convention on Human Rights, namely the right to a fair judicial process, proceedings and the right to question witnesses. In this regard, Armenia should pay Dadayan compensation for moral damage in the amount of 2,400 euros and 1,000 euros for legal costs.
To recall, two smugglers were brought to justice and convicted in Georgia, while Dadayan was prosecuted and convicted in Armenia, in fact on the basis of smugglers' testimony to the Georgian authorities.
The court, in particular, noted that Dadayan's rights were significantly impaired, since the Armenian court of first instance did not interview smugglers personally. The Georgian authorities refused to transfer the smugglers to Armenia because a criminal case was opened against them in Georgia.
