The second president of Armenia Robert Kocharyan's lawyers are considering the possibility of applying to the Court of Cassation, one of the lawyers of Kocharyan, Hayk Alumyan told "Radio Liberty". According to him, the lawyers of Robert Kocharyan are discussing the question of whether to appeal the decision of the Court of Appeal to the Court of Cassation.
As the lawyer noted, in their appeals they submitted substantive grounds for release, but the court preferred to base its decision on the constitutional norm of the ex-president's immunity. "We had two arguments that should be submitted to the Court of Cassation as well," the lawyer said, stressing that the decision to appeal is not final, it is being discussed. The lawyer noted that the investigating body refuses to fully publish the charge. Lawyers, in turn, are limited in their rights to publish charges, as a result the presentation of the reality to public becomes problematic. At the same time, as Alumyan pointed out, it is very important for everyone to understand the content of the charge. "The public should understand that Robert Kocharyan is not charged with the murder of 10 or even 1 person", he declared.
Yesterday the Armenian Court of Appeal granted the petition of the lawyers of ex-President Robert Kocharyan and canceled the decision of the first instance court. According to his lawyer Ruben Sahakyan, the constitutional rule on the inviolability of the former heads of state became the basis for changing the measure of restraint.Sahakyan called on to address the investigation the question of how the court process should further proceeed. However, he did not rule out the complete closure of the criminal case on the usurpation of state power in 2008.
