The Special Investigative Service (SIS) of Armenia decided to apply the measure of restraint in the form of a written undertaking not to leave the country in respect of the second president Robert Kocharyan, accused of overthrowing the constitutional order in the framework of the case on the events of March 1, 2008. This is reported by the SIS.
It is noteworthy that earlier the Court of Appeal, having reviewed the decision of the court of general jurisdiction on the application of arrest as a measure of restraint against Kocharyan, released him, referring to the constitutional immunity of the heads of state and not having defined any preventive measure against the second president.
Nevertheless, the SIS confiscated the passports of the second president without any legal grounds, which became an obstacle to Kocharyan's departure abroad for the purpose of passing medical examination. Already after the statements of Kocharyan's lawyers about the unlawfulnes of such a step, the SIS, the post factum made a decision to apply a measure of restraint against Kocharyan as a written undertaking not to leave the country in order to have a legal basis not to give him a passport.
