If the Constitutional Court of Armenia finds the laws adopted by the National Assembly of the Republic of Armenia on the nationalization of Electric Networks of Armenia CJSC to be unconstitutional, as adopted on December 16, the entire current process will be considered unconstitutional. This was stated by Ara Noanyan, a member of the Public Services Regulatory Commission of the Republic of Armenia, commenting on his decision to vote against revoking the company's license.
According to Noanyan, this issue was raised during the discussions, but the response was that the PSRC is guided by facts, not expected decisions. However, the Law "On the Public Services Regulatory Commission" clearly stipulates that in such cases, proceedings must be suspended for 33 days. Noanyan also noted that he has not received an answer to the question of what would happen if the entire process is deemed unconstitutional. He also pointed out that the Commission initiated proceedings based on the authorized body's assumptions, while the subsequent review of the matter by the PSRC was based on entirely different grounds, which is completely inconsistent with the PSRC's usual research methodology. When initiating proceedings, it is crucial to hear the positions of the parties, but in this case, there is virtually no other party.
As a reminder, on November 17, by decision of the PSRC, Electric Networks of Armenia CJSC was stripped of its electricity transmission license. On June 18, law enforcement agencies arrested, and then the court remanded in custody, Samvel Karapetyan, a leading businessman and head of the Tashir Group of Companies, on charges of calling for the overthrow of the constitutional order. This occurred only because the latter, speaking in defense of the Armenian Apostolic Church, stated in an interview that "we will intervene in our own way" if politicians fail to fulfill this function. Following Karapetyan's arrest, the authorities effectively took control of ESA from the Karapetyan family, appointing Romanos Petrosyan, a member of the Civil Contract party, as its interim manager.
