ArmInfo. Yerevan Mayor Tigran Avinyan has again lost the case brought against Ishkhan Saghatelyan, a member of the opposition Hayastan National Assembly faction. A final, non-appealable ruling in the third case has entered into force. Saghatelyan's lawyer, Vahe Grigoryan, wrote about this on his Facebook account.
"Regarding the protests and emergency rallies of the Resistance movement that took place in 2022, the Mayor of Yerevan has filed four lawsuits against Ishkhan Saghatelyan, demanding a fine of up to 300,000 drams for his role as the organizer, for a total of 1,200,000 drams." I represent Ishkhan Saghatelyan in all four relevant cases, and I defend his rights and freedoms in these cases both in the Administrative Court and the Administrative Court of Appeals.
Previously, the Administrative Court upheld our request in four cases, dismissing the Yerevan Mayor's claims against Ishkhan Saghatelyan.
Dissatisfied, the Yerevan Mayor appealed the Administrative Court's decisions, and after the 2023 Yerevan Council of Elders elections, the appeals were not withdrawn," the lawyer noted.
Furthermore, having lost three cases in the Court of Appeals, Avinyan's appeals were also dismissed in the Court of Cassation.
"Shortly earlier, I received the Cassation Court's decision rejecting the Yerevan Mayor's cassation appeal in the third case. The decision enters into legal force from the moment it is issued, is final, and is not subject to appeal.
Incidentally, the Yerevan Municipality had no right to file a cassation appeal. Only the Yerevan Mayor could have been the appellant in this case.
The latter case is still pending in the Administrative Court," Vahe Grigoryan wrote.
