The Armenian authorities want to establish a norm by which the government will be able to determine the procedure for the amount of just compensation established by European Court decisions. Amendments to the Law "On the Representative on International Legal Issues" are being discussed in the first reading at the plenary session on November 11.
Introducing the amendments, Commissioner for International Legal Issues Karen Andreasyan noted that the payment of just compensation in the amount established by the decisions and rulings of the European Court is an unconditional obligation of the Republic of Armenia. However, Andreasyan continued, it should be noted that in order to receive just compensation within the established timeframe, applicants must submit the necessary documents, which in practice poses certain challenges. Specifically, applicants sometimes submit the required documents incompletely or within a timeframe that prevents the Office of the Prime Minister of the Republic of Armenia from ensuring the payment of just compensation within the established timeframe. Furthermore, RA legislation lacks legal regulation of the process for paying just compensation. The proposed amendments establish the procedure for submitting documents and the procedure for paying fair compensation. Fair compensation is defined as the amount of payment determined by the European Court.
Karen Andreasyan noted that, although fair compensation payments are still being made in practice, the lack of a legal framework has consistently led to various practical problems, which are addressed by the proposed regulation.
