
ArmInfo. The Ministry of Labor and Social Affairs of Armenia has submitted for public discussion a package of draft laws that would remove the maximum age limit for holding certain positions from several laws. This means that individuals who have reached 65 years of age will be allowed to continue working in the positions stipulated by these laws.
As stated in the draft law, posted on the Unified Portal of Legal Acts, in connection with the repeal of Clause 7, Part 3, Article 95 and Clause 11, Part 1, Article 113 of the Labor Code, effective July 31, 2023:
An employer may not terminate an employment contract upon reaching the age of sixty-three by an employee entitled to an old-age pension, or upon reaching the age of sixty-five by an employee not entitled to an old-age pension.
An employer may not enter into a fixed-term employment contract with an employee solely on the basis that the employee is eligible for an old-age pension and has reached the age of sixty-three, or is not eligible for an old-age pension and has reached the age of sixty-five.
However, Part 2 of Article 1 of the Code stipulates that the specifics of regulating individual areas of labor relations may be established by law. In this regard, it should be noted that a number of RA laws still retain provisions regarding the termination or non-conclusion of employment contracts based on age.
In this regard, the presented package of bills proposes amendments to the laws "On Civil Service," "On Public Service," "On Public Works," "On State Non-Commercial Organizations," "On Scientific and Scientific-Technical Activities," "On the Protection of Personal Data," and "On Vocational Education and Training," which would eliminate the age limit for employment from these laws. By eliminating the age limit imposed by the proposed amendments, termination of employment with employees will be carried out on the general basis established by law, without establishing an exceptional age limit for termination.
