Sign peace agreement and all your fears will be dispelled - Pashinyan  to Aliyev 

ArmInfo.If the Constitutional Court of Armenia decides that the text of the peace agreement does not comply with the Constitution of the Republic of Armenia, which is unlikely, I will initiate constitutional reforms, because the peace process and the agreement cannot be missed. We will persuade society to make changes to achieve lasting peace. This was stated by RA Prime Minister Nikol Pashinyan on May 26 at the opening of the international forum "Yerevan Dialogue-2025", presenting the obstacles to achieving peace between Yerevan and Baku and ways to solve them.

Pashinyan recalled that Yerevan and Baku managed to agree on the text  of the draft Agreement "On the Establishment of Peace and Interstate  Relations". "The document has been finalized, the negotiations have  been completed, Armenia and I personally have stated that we are  ready to sign the document," he emphasized.

At the same time, the Prime Minister noted, Azerbaijan officially  links the signing of the peace treaty to 2 issues. The first concerns  the dissolution of the OSCE Minsk Group, which was created to serve  as a negotiating platform between the Republic of Armenia and the  Republic of Azerbaijan.

We have  repeatedly said that there cannot be Western Azerbaijan on the  sovereign territory of the Republic of Armenia>, - Pashinyan said,  recalling that Yerevan proposes to simultaneously sign two documents  - a peace treaty and an appeal to the OSCE with a proposal to  dissolve the Minsk Group, which is a constructive approach.

Another voiced by Baku concerns the fact that the  Constitution of the Republic of Armenia allegedly contains  territorial claims against Azerbaijan. In general, the head of the  Armenian Cabinet noted, it is logical that mutual renunciation of  territorial claims should be key in the issue of signing a peace  treaty. And the only structure capable of clarifying the situation  regarding the presence or absence of such claims in the Basic Law of  the country is the Constitutional Court of Armenia. However, last  year the latter considered the , based on  the Alma-Ata Declaration of 1991, to be in accordance with the  Constitution, which indicates the absence of territorial claims of  the Republic of Armenia to the Republic of Azerbaijan.

In addition, the Armenian Prime Minister noted, the agreed text of  the draft peace agreement contains a provision that they recognize  the administrative borders of the Union Republics as the  international borders of the Republic of Armenia and the Republic of  Azerbaijan. Both countries recognized each other's territorial  integrity, sovereignty, and the inviolability of borders. Another  agreed provision concerns the mutual renunciation of territorial  claims both at this stage and in the future. That is, Armenia and  Azerbaijan agreed in the draft peace treaty that there are no  territorial claims, the Prime Minister emphasized. Another provision  is that the parties cannot use their own legislation as a  justification for not fulfilling the agreement. According to the  legislation of the Republic of Armenia, he explained, the agreement  must be sent to the Constitutional Court to study its compliance with  the Constitution of the Republic of Armenia.

 

What will be the position of the Republic of Armenia and mine? In  this case, I will initiate constitutional reforms because the peace  process and the treaty cannot be missed. Let's persuade society to  make changes to achieve lasting peace.

If the Constitutional Court decides that the draft is fully compliant  with the Constitution of the Republic of Armenia, there will be no  obstacles to sending it to the National Assembly for ratification.  After ratification, the document will receive the highest legal force  in the Republic of Armenia. According to paragraph 3 of Article 5 of  the Constitution, which assumes that in case of contradictions with  domestic legislation, the norms of ratified international treaties  are applied.

This means that the peace treaty will resolve all concerns that  Azerbaijan may have. Thus, it is clear that the way to resolve Baku's  concerns is to sign, and not to refuse to sign the treaty. Be 100%  sure that all concerns will be dispelled, for this we need to sign.  This is our main message>, - Pashinyan said. At the same time,  Pashinyan emphasized that Armenia sees certain territorial claims  against the Republic of Armenia in the Constitution of Azerbaijan.  , he added.

As the Prime Minister pointed out, some experts believe that the  concerns voiced are just a pretext for postponing the signing.  Meanwhile, the Armenian government wants to believe that Baku's  concerns are sincere.

, - Pashinyan  said. He recalled that in 2024, the parties managed to delimit a 12.7  km long section of the border, where <100% peace and security  guarantees> were established.
