ArmInfo. Avetik Chalabyan, a public and political figure and coordinator of the "Hayakve" initiative, believes that the statement by RA Prime Minister Nikol Pashinyan regarding the phone of RA National Assembly deputy Hovik Agazaryan contains elements of a crime.
On his Facebook page, Chalabyan recalled that on December 4, while speaking from the rostrum of the National Assembly, Prime Minister Nikol Pashinyan, among other statements, gave very important testimony about the unprecedented act he had committed. In particular, answering a question from MP Agnesa Khamoyan, he admitted that he had allegedly received a report from the NSS on the data on MP Hovik Agazaryan's phone, which contained a leak of state secrets, after which he shared this data with the board of the Civil Contract party, on the basis of which a decision was made to expel Hovik Agazaryan from the party.
"In this regard, I have several questions: if the NSS report contains data constituting a state secret, on what basis did Nikol Pashinyan share this data with the board members, at least some of whom do not have the appropriate permission to access state secrets, and is this in itself a leak of a state secret committed by an official? In addition, if the information contained in the NSS report was obtained in the context of actions within the framework of the preliminary investigation, is its provision to persons not related to the preliminary investigation - the Prime Minister, members of the State Duma board - not a violation of the secrecy of the preliminary investigation? If Hovik Aghazaryan is a member of the RA Parliament, and the National Assembly has not yet lifted his parliamentary immunity, is the Investigative Committee authorized to carry out investigative actions against him, in particular, seize his phone and transfer his data constituting a personal secret. If all this did not contain any state secrets, and it was just a leak of information, on what basis is the NSS interfering in this matter at all? And vice versa, if there really is a leak of state secrets, where did this information come from, who provided it to him? This list of questions can be continued for a long time, but it is obvious that this incident clearly demonstrates the entire level of lawlessness and legal chaos that reigns in the Armenian government system," Chalabyan said.
He added that what is happening is typical of dictatorial states, where there is no separation between state and party bodies, executive and legislative power, where law enforcement agencies obey the orders of the dictator, and not the law. "The end of such dictatorial authorities is also very predictable, and the incident with Hovik Agazaryan shows that it is approaching irreversibly. I suggest that the RA Prosecutor General not wait for this beautiful day, accept this post of mine as a report of a crime and initiate criminal proceedings to answer all these questions. If the Prosecutor General does not do this for reasons that are clear to all of us, I suggest that the prosecutors remaining in the system, who are still faithful to their oath to serve the Constitution and the laws of the RA, do it for her, they have the right to do so. I myself am ready to contribute to this happening one day and help restore our citizens' faith in the law and legality," the public and political figure emphasized.
