ArmInfo. The area allocated for the school was alienated to an individual in violation of the law. Based on the prosecutor's conclusion, a criminal case was initiated. In particular, as reported by the Prosecutor General's Office, during a study of the cadastral file of the state land plot allocated to primary school No188 named after Gevorg Chaush at 5 Beknazaryan Street in Yerevan, it was revealed that by December 2, 2002 decision of the capital's municipality, 19,080 square meters of land was allocated to the School with the right of free (permanent) use.
According to the decision of the Mayor of Yerevan dated August 1, 2008, a land plot with an area of 148.71 square meters from the abovementioned area allocated for the school, on which citizen S.Y. built a voluntary production building with an area of 132.4 square meters, was recognized as the property of Yerevan Municipality and on November 14 of the same year, it was alienated by direct sale to the citizen who built it. Meanwhile, according to the Law "On Education", the property of state educational institutions in the event of expropriation can be used only for educational purposes.
Taking into account that during the investigation the alleged crime, as well as other cases, were found, the prosecutor submitted a report of the crime to the Anti-Corruption Committee. On December 20, 2023, the Anti-Corruption Committee opened a criminal case under Part 1 of Article 308 (exceeding official powers) and Part 1 of Article 314 (official forgery) of the Criminal Code, adopted on April 18, 2003.
