ArmInfo. The body that has some responsibility for enforcing the decisions of the International Court of Justice is the UN Security Council. Yeghishe Kirakosyan, representative of Armenia on international legal issues, stated this during a press conference on February 27.
He emphasized in this context that in case of problems in the context of the implementation of decisions, the Security Council has the authority and must intervene. However, Kirakosyan noted that this is a somewhat problematic process, because, as he explained, "there are permanent members of the UN who work according to their own logic, and the level of politicization of this issue is at a fairly high level."
At the same time, the representative of Armenia stressed that, nevertheless, it is possible to "pick the fruits" of the legal process. In this regard, Kirakosyan said that the foreign ministries of a number of countries have already begun to make statements, referring to the decision of the International Court of Justice. <This is an extremely important process. And it is necessary to maximize the pressure in this direction>, he said.
At the same time, Yeghishe Kirakosyan stressed that thanks to the decision of the International Court of Justice, Armenia received a second legal document at its disposal, in addition to the Trilateral Statement of November 9, 2020, which obliges Azerbaijan to ensure unimpeded traffic along the Lachin corridor (Goris- Stepanakert road).
On February 22 this year, the International Court of Justice ordered Azerbaijan to make every effort to ensure the uninterrupted movement of people and vehicles along the Lachin corridor. The court applied a temporary measure against Azerbaijan, which is obliged to unblock the corridor in the bilateral direction.
As Armenian Prime Minister Nikol Pashinyan noted at a cabinet meeting on February 23, the International Court of Justice granted Armenia's request, rejecting the Azerbaijani one. Baku's groundless accusations against Armenia "about mining" collapsed, he noted. By the aforementioned decision, the Court found that there is an imminent threat of causing irreparable damage to the rights of Armenians under the Convention and ordered Azerbaijan to take all necessary measures to ensure the unhindered movement of persons, vehicles and goods along the Berdzor (Lachin) corridor in both directions. According to Pashinyan, the International Court of Justice thus states that since December 12, 2022, the Lachin corridor has been closed. At the same time, the Court confirmed the position of Armenia that, with a tripartite statement dated November 9, 2020, Lachin Corridor should not be under the control of Baku, but under the Russian peacekeeping contingent's control. And Azerbaijan is obliged to guarantee the uninterrupted and safe movement of people, vehicles and goods along the corridor. The Court clearly recorded the existence of the Nagorno-Karabakh entity in accordance with the trilateral declaration and its provisions of November 9, 2020. Among them, legal significance was attached to Nagorno Karabakh and the presence of the contact line," Pashinyan said.
