ArmInfo.Yeghishe Kirakosyan, Armenia`s representative at the European Court of Human Rights (ECHR) has been dispatched to The Hague, Netherlands, to attend the delivery of the International Court of Justice Order on the request for the indication of provisional measures made by the Republic of Azerbaijan in the case concerning Application of the International Convention on the Elimination of All Forms of Racial Discrimination (Azerbaijan v. Armenia) and of the International Court of Justice Order in the case concerning Application of the International Convention on the Elimination of All Forms of Racial Discrimination (Armenia v. Azerbaijan).
The Republic of Armenia lodged a claim with the International Court of Justice against Azerbaijan. Armenia accused Azerbaijan of violating the International Convention on the Elimination of All Forms of Racial Discrimination. The Armenian side claims that Azerbaijan had for decades practiced racial discrimination against Armenians and the government-sponsored anti-Armenian policy resulted in mass killings, torture and other crimes against Armenians. According to the claim, the violations proved to be obvious during the 2020 hostilities unlashed by Azerbaijan, which once again grossly violated the International Convention on the Elimination of All Forms of Racial Discrimination. The claim is suppose to protect Armenia and Armenians from further violations and prevent disagreements. So Armenia requested provisional measures against Azerbaijan claiming it to be an urgent issue.
In response, the head of the press service of Azerbaijani MFA Leyla Abdullayeva told reporters that, besides the first claim lodged by Azerbaijan with the European Court on Human Rights this January, Azerbaijan intended to file a claim to the International Court of Justice about Armenia's violation of the "1965 International Convention on the Elimination of All Forms of Racial Discrimination." She noted that "after the end to illegal occupation of part of Azerbaijan`s territories, the facts have been collected and documented proving gross violations of human rights against Azerbaijanis." Among them are expulsion, torture, murders of Azerbaijanis for ethnic reasons, Abdullayeva said. According to her, "after the trilateral statement was signed Armenia continued violating the ICERD by preventing repatriation of ethnic Azerbaijanis by mining the once occupied territories and refusing to hand the maps over to Azerbaijan."
The International Court of Justice is to deliver its Orders on December 7.
