Armenian Minister of Health Anahit Avanesyan did not rule out the fact, that the employer has the right terminate the employment contract with the employee in case of refusal of vaccination or to provide the result of the PRC test for coronavirus. Health Minister Anahit Avanesyan stated this during a briefing with journalists. She noted that only pregnant women and people with a medical conclusion about contraindications to vaccination can be an exception.
The Minister explained that without vaccination or the provision of the results of the PCR test, the employee will not be able to visit the workplace. "If an employee does not come to work for a certain period, then the employer has the right to terminate the employment contract," Avanesyan said. The consequences of such behavior are also fraught with enterprises, which will be forced to pay certain fines.
When asked whether the minister sees in such regulations violations of human rights, contradictions to the Labor Code, Avanesyan objected: "Everything is done within the framework of the RA Constitution and law." She recalled that in Armenia there is a law on ensuring the sanitary and epidemiological safety of the population of the Republic of Armenia, which clearly indicates, referring to which provisions, by-laws were adopted. The new regulations fully comply with all legal requirements. Human rights can be limited only in cases stipulated by law," she said.
