ArmInfo. The judge in the case of second President of Armenia Robert Kocharyan, Anna Danibekyan, postponed the decision on the lawyers' petition to provide the defense with the missing materials in the case of March 1, 2008.
As ArmInfo previously reported, at the last meeting the defense side stated that the events of March 1, 2008 are not fully reflected in the case materials that the defense side has. "Today, the defense has a little more than 10% of the total volume of documents, namely: 80 volumes of the criminal case, while their total number is 600," lawyer Hayk Alumyan said.
Prosecutor Gevorg Baghdasaryan did not agree with this position of the lawyer, stating that the defense is trying to get more information than it should. Also, according to Baghdasaryan, the prosecutor's office needs a full volume of case materials in order to build accusations, and lawyers are not constrained to provide evidence to the court.
In turn, another prosecutor Petros Petrosyan stressed that the statements about the equality of the parties are exaggerated. The prosecutor also said that the functions of selecting materials are assigned to the investigator and the court cannot interfere with this.
As a result, the judge stated that the court could not assess the arguments of the defense, which were at the basis of their petition, and postponed the decision on this issue until all the evidence gathered in the criminal case had been considered.
To note, second President of Armenia Robert Kocharyan is accused of overthrowing the constitutional order in the framework of the March 1, 2008 events.
To recall, as a result of clashes at opposition rallies that followed the 2008 presidential elections in Armenia, in which Serzh Sargsyan won de jure, 10 people died on March 1. The investigation into the case is still ongoing. Within the framework of the case on charges of overthrowing the constitutional order, second president of Armenia, Robert Kocharyan, and a number of high-ranking officials of that time are involved.
