ArmInfo. A judge of the Constitutional Court shuld have an independence of judgment and an impartiality of opinion, I believe that I have these qualities. Artur Vagharshyan, candidate for the position of judge of the Constitutional Court, stated this from the rostrum of the parliament.
Vagharshyan noted that during the implementation of constitutional justice, it should understood that both the Constitution and the law have very clear wording, however, sometimes there are discrepancies.
"I believe that in these issues one should show special scrupulousness and delve into the essence of the issue. I also think that it would be right to listen to the position of Armenian lawyers for some of these issues," he said. The candidate for a judge of the Constitutional Court also stressed that now he does not want to express his point of view regarding the upcoming estates in the courts.
"It should be understood that the Constitutional Court has a very important role, and it should be understood that it has the right to express its opinion on the constitutionality of certain bills. And if it made a negative decision on any act or bill, it should not act. The decisions of the Constitutional Court should not be considered as an advisory opinion, all decisions must act," Vagharshyan said. Vagharshyan also touched upon the dissatisfaction of the opposition factions, regarding the fact that candidates for the position of a judge of the Constitutional Court did not meet with them.
"It did not occur to me that the initiative for the meeting should come from me. If I knew that I should initiate a meeting, I would organize a meeting with all factions. I would like to answer all the questions of interest to the MPs," he said. The candidate for the position of a judge of the Constitutional Court stressed that, as often in a number of European countries, people who have a scientific degree are elected as judges of the Constitutional Court, but they are not always judges. <The presence of judicial practice in this matter may interfere.
