ArmInfo.The team of lawyers of second President of Armenia Robert Kocharyan made a statement in connection with the complaint sent by the prosecutor's office to the court to challenge the verdict against their client.
Thus, the statement reads in particular: "The cassation court should not accept the complaint of the prosecutor's office for proceedings.
We would like to note that the Court of Cassation has not yet accepted the appeal of the defense of Robert Kocharyan into proceedings, which is strange and problematic: there is no need to wait two months, the court had to immediately accept the case into proceedings. The lawyers dispute that paragraph of the decision of the Criminal Court of Appeal of June 18 of this year, in which it is noted about the likelihood of obstructing the investigation of the case by exerting influence by Kocharyan on the persons participating in the trial. The court considered that the application of the bail could be a deterrent and applied an unprecedented bail for Armenia in the amount of 2 billion drams.
As you know, the General Prosecutor's Office also filed a cassation appeal against the decision of the Court of Appeal. The advocacy group believes that the Court of Cassation should not accept the complaint of the prosecutor's office for proceedings, but leave it without consideration, since the law did not give the prosecutor the right to file a cassation appeal against decisions related to preventive measures.
Recently, much speculation has also been made on the decision of the administrative court on the stay of Robert Kocharyan in the Izmirlian MC in connection with the coronavirus infection in the country. The court satisfied the motion of the lawyer Arman Orbelian to secure the claim, allowing R. Kocharyan to stay in the hospital.
We consider it necessary to emphasize that the claim for keeping Kocharyan in the hospital does not indicate that his condition is serious. The lawsuit filed and the means of securing the claim related to the fact that in the conditions of thpandemic, Kocharyan's transfer from the hospital to the penitentiary institution could be considered as inhuman treatment, given that he was at risk. "
It should be noted that on June 18, the Criminal Court of Appeal, chaired by Judge Arsen Nikoghosyan, satisfied the lawyers' complaint against the decision of the court of general jurisdiction to reject the petitions to change the preventive measure against Kocharyan. He was released on bail of 2 billion drams on June 20. The trial against him is ongoing.
Kocharyan was arrested in Yerevan in July 2018 after being charged with overthrowing the constitutional order in the March 2008 case. Prior to the decision to release Kocharyan from custody on bail, the Administrative Court granted the motion of Robert Kocharyan's lawyer Arman Orbelian that until the end of the coronavirus pandemic, the second president of Armenia will be in the Izmirlian medical center, where he receives appropriate treatment.
