ArmInfo. On September 7, the court satisfied the petition of the defense side to cancel the preventive measure against former Deputy Chief of Staff of the National Assembly Arsen Babayan.
To recall, on November 12 last year, the measure of restraint against Babayan was changed from arrest to personal surety.
Arsen Babayan was charged with part 1 of Article 38-300 (complicity in the usurpation of state power) and part 1 of Article 314 (official forgery) of the RA Criminal Code.
According to the investigation, in particular, former head of the Constitutional Court Gagik Harutyunyan, whose term of office (70 years) was supposed to end on March 23, 2018, signed a statement addressed to NA Speaker Ara Babloyan to resign from the post of CC President, which was dated March 1, 2018.
This statement was sent from the general department of the CC staff and, through the head of the staff, was handed over to the acting Deputy Chief of Staff of the National Assembly Arsen Babayan on March 5.
Moreover, NA Speaker Ara Babloyan, having not officially received this statement from Gagik Harutyunyan, on March 2 illegally signed and made a statement on the submission of resignation by the head of the Constitutional Court Gagik Harutyunyan. Otherwise, the head of the National Assembly would not have the opportunity to announce the resignation of the head of the Constitutional Court until the next regular sitting of the National Assembly on March 20, 2018.
