ArmInfo.The Prosecutor General's Office opened a criminal case on the basis of torture of the detainee by law enforcement officers.
As reported by the Prosecutor General's Office, on June 7, from the place of detention of the detained persons, the Erebuni department of the RA Police received a notification that citizen K.M. was admitted with numerous bruises and abrasions. The night before K.M. argued with his neighbor, and then used violence against the police who arrived at the scene. On this fact, on June 7, a criminal case was initiated under Part 1 of Article 316 of the Criminal Code of Armenia. On the same day, K.M. explained that he had been injured while cutting down the branches of a dead tree in the courtyard of the house, adding that no one had used violence against him or caused him bodily harm. On June 17, based on materials prepared in connection with the incident, it was decided to refuse to initiate a criminal case on the basis of the absence of a crime. Meanwhile, on August 10, the RA General Prosecutor's Office received a statement from K.M., in which he said that the injuries found on his body were the result of violence from the police officers who arrived at the scene, and he had not previously reported this in exchange on the promise of the investigator to terminate the criminal proceedings.
As a result of the checks carried out, the Prosecutor General of Armenia canceled the decision to refuse to initiate a criminal case on the basis of the absence of corpus delicti, and on the fact of the obvious torture of a person by a group of persons initiated a criminal case on the grounds of paragraph 4 of part 2 of Article 309.1 of the RA Criminal Code.
