ArmInfo.Candidates for the position of judges of the anti- corruption court will undergo multi-stage short listing. This was announced on August 14 by the Deputy Minister of Justice of the Republic of Armenia Srbuhi Galyan during the discussions on the establishment of this judicial body.
It should be reminded that the relevant draft, which has already been submitted for public discussion, proposes to create a specialized anti-corruption court with at least 25 judges, 20 of whom will consider cases on corruption offenses provided for by Appendix 6 of the RA Criminal Code, and 5 - cases arising from applications and claims filed under the law on the recovery of property of illegal origin. The package of projects also proposes to create a specialized anti-corruption court of appeal with at least 10 judges. According to the proposed draft amendments, the criminal chamber in the Court of Cassation will consist of 8 judges, and the civil and administrative chamber - 13 judges, respectively.
The draft establishes the procedure for replenishing the anti-corruption specialization department of the list of candidates for judges, as well as requirements for these candidates, restrictions on appointment as judges, and the structure of verification in all instances of the integrity of candidates for judges. In particular, as Galyan informed, the integrity of a candidate for a judge will be checked by the Anti- Corruption Commission, taking into account the expert advisory opinion. Certain requirements are imposed on candidates for the office of a judge. Thus, the candidacies will not be considered if, during the performance of their previous duties, they received disciplinary action and were brought to disciplinary responsibility. In addition, those candidates, according to whose court decisions the ECHR subsequently revealed violations of human rights, will not be considered.
Galyan also noted that the competition for the position of judges will be held on an open and transparent basis, and the public will have the opportunity to get acquainted with this information. Competitively selected candidates will take specialized courses and will be appointed to judicial positions based on positive ratings.
