ArmInfo.The preliminary investigation confirmed the fact of fraud on the part of the judge of the court of general jurisdiction of the city of Yerevan, David Grigoryan. According to the Investigative Committee, these actions were carried out with the assistance of the secretary of the court hearings of the same court, Gor Vardanyan.
According to the source, on September 7, 2018, the court of general jurisdiction of Yerevan received a citizen's complaint against the decisions of the investigator and prosecutor, the consideration of which was entrusted to judge David Grigoryan. Meanwhile, Grigoryan, with the assistance of Vardanyan, drew up a false protocol on holding a court hearing on September 14, 2018, including false information that the plaintiff, as well as representatives of the IC and the prosecutor's office, allegedly did not appear in court, on the basis of which the hearing was adjourned . After compiling the aforementioned protocol, which contains deliberately false information, and confirming it with his signatures, Grigoryan and Vardanyan appended it to the materials of the court case. The false protocol on the allegedly held court session was compiled by the above-mentioned persons and regarding the application from the State Probation Service received on September 11, 2018. Based on this protocol, the court session was rescheduled, and the document with false information was attached to the materials of the court case.
For these criminal acts, Grigoryan was charged under part 1 of Article 314 (two episodes), and Vardanyan - against part 1 of Article 38-314 (two episodes) of the RA Criminal Code. Preliminary investigation completed; the case with the indictment was transferred to the supervising prosecutor with a request to send it to the court.
To recall, in May last year, David Grigoryan decided to release the former President of Armenia Robert Kocharian from custody, under the guarantee of the former and current Presidents of Artsakh. Grigoryan later suspended the proceedings and sent him to the Constitutional Court. Further, the Court of Appeal noted this decision and again arrested Kocharyan, directing the case for further investigation. However, Grigoryan suspended the proceedings and sent it to the Constitutional Court to clarify the constitutionality of the article charged with Kocharyan, as well as to determine the essence of the institution of immunity. Last summer, the High Judicial Council suspended his powers as a judge, and also agreed to institute criminal proceedings against him.
