ArmInfo.In Armenia, courts will be allowed to refuse to apply for arrest as a preventive measure. The RA National Assembly at the meeting on April 14 in the second and final reading amended the Code of Criminal Procedure.
According to the Deputy Minister of Justice of the Republic of Armenia, Srbuy Galyan, it was established by the decision of the Constitutional Court that by April 15 this year is necessary make appropriate amendments to the current legislation of the country in order to resolve issues related to preventive measures. For this reason, the document is submitted in the current order to be in time by the deadline set by the COP. It is proposed, in particular, when choosing a preventive measure to apply alternative preventive measures - bail, house arrest, recognizance not to leave. The bill also provides grounds for the courts to release suspects. Moreover, the form of the pledge is considered not as an alternative form of a preventive measure, but as a separate measure. The use of one form or another is carried out by the body conducting the investigation. Moreover, in the implementation of the pledge, if the suspect commits unlawful acts, the subject of the pledge may be nationalized by the state.
