The draft amendments to the RA Law "On Alienation of Property with a View to Ensuring Priority Public Interests" submitted by the Vice-Speaker of the National Assembly of the Republic of Armenia from the Prosperous Armenia Faction Vae Enfijijan.
The deputy noted that the bill proposes to increase the amount of compensation paid to the owner for the alienated property. "In territories recognized as a priority public interest, in fact, illegal actions and arbitrary approaches are recorded. The property of a citizen in the Republic of Armenia should be protected, and in case of alienation of property, its compensation should be equivalent and full. And so that residents do not have problems, the requirement compensation should be very clear, "Enfiajyan said. Equal compensation is paid to the owner for property alienated under the current law. The amount equal to the market value plus 15% of the market value of the alienated property is considered equal. The deputy suggests that when calculating the compensation paid to the owner for the alienated property, to establish a premium to the market value of 25%. Enfiajyan noted that prior to the development of the draft law, he had many meetings with citizens who faced these problems. However, as the deputy from the ruling "My Step" faction Artashes Petrosyan noted, the problem does exist, however, it should not be resolved by the bill. He noted that the examples provided by Enfijajyan concern only the center of Yerevan and are directly related to the business sphere, which, according to the current legislation, has the direct ability to establish mutual obligations with the beneficiary. The MP also pointed to the calculations provided by Enfijan. "It is not clear why 25%, not 30 or 40%, the lack of clear calculations also indicates the imperfection of the presented document," said Artashes Petrosyan.
It should be noted that earlier, a government representative and first deputy minister of justice Rafik Grigoryan noted that there really are problems in this area. "However, the presented draft is not aimed at solving these problems. The court precedents we presented justify that the European Court also attaches importance to the requirement of fair compensation. It requires adequate market compensation. The Ministry of Justice is addressing this issue. We believe that there are problems in this area, which were discussed in a number of courts, however, these problems are mainly associated with examinations, incorrect assessment, criteria of priority public interest, and not with compensation its 15% ", - said Grigoryan.
As a result of the vote, the bill gained only 40 votes in favor, which is not enough to include the issue in the big agenda of the RA National Assembly.
