As part of the pre-trial proceedings completed at unjustified expenses, more than 70% of the damage or 248.4 million drams caused to the state and communities in the total amount of 346.5 million drams was restored, the press service of the Prosecutor's Office of the Republic of Armenia reported.
The report notes that the RA Prosecutor's Office is taking measures to protect the property interests of the state in the conditions of refusal to initiate criminal proceedings on grounds not justifying corruption, termination of proceedings and failure to prosecute or make decisions to terminate the criminal prosecution.
According to the source, in the first half of 2019 a criminal case was opened in the prosecution department of the General Prosecutor's Office of the RA General Prosecutor's Office and territorial divisions of the prosecutor's office to initiate criminal proceedings on the indicated basis, 17 criminal cases were opened, criminal proceedings were terminated or not carried out in 86 criminal cases, (a total of 103).
<27 of them were terminated or criminal proceedings were refused after the statute of limitations, 34 cases in connection with the application of an amnesty, 3 due to the death of a person subject to criminal prosecution, and 39 on the grounds of effective repentance, "the statement said.
In respect of 122 persons, decisions were made on the non-implementation of criminal prosecution on not justifiable grounds or the termination of the criminal prosecution.
For the same period of 2018, criminal proceedings were denied on non-justifiable grounds, the criminal proceedings were discontinued and criminal prosecutions were not carried out, or the criminal prosecution was stopped in criminal cases initiated on the fact of 38 cases of corruption, i.e. 3.5 times less than for the first half of 2019.
Thus, decisions were made on the non-implementation of criminal prosecution of 63 persons on non-justifiable grounds or on the termination of the criminal prosecution.
<The noted indicators indicate that the Prosecutor General's Office and other criminal prosecution bodies have been consistently carried out and, in particular, since 2018, that if the damage to the state in corruption cases is restored, if there are sufficient grounds, the use of promotional tools, up to and including exemption from criminal liability in the manner prescribed by law>, the department noted.
This, as stated in the statement, is also evidenced by the fact that in the first half of 2019, the damage caused to the state and communities in the above criminal cases amounted to
346.5 million drams, of which, as a result of warnings from prosecutors, a total of 248.4 million drams, or 71.6 percent, were voluntarily restored.
In all cases of not continuing criminal prosecution with the use of discretion, the damage has been fully repaired. In particular, in 4 cases, the prosecutors submitted claims in the amount of about 18 million drams, the consideration of which is in progress.
Prosecutors also submitted proposals to the relevant state or municipal authorities to take the initiative to file a claim for damages in cases completed on non-justifiable grounds>, the report says.
