ArmInfo.The lawyers of the second President of Armenia Robert Kocharyan filed an appeal against the decision of the court of first instance to arrest the former President, accused of overthrowing the constitutional order in 2008.
Lawyers note that, taking into account the decision of the Constitutional Court of Armenia, in which the latter invalidated Article 35 of the Code of Criminal Procedure (circumstances that exclude criminal proceedings and criminal prosecution), the Constitutional Court questioned the legality of the arrest of the former President.
Kocharyan's defense noted that, taking the verdict of the Constitutional Court as a basis, Robert Kocharyan should be immediately released from custody. The lawyers also want to end the criminal prosecution of the second president of Armenia.
It should be noted that on September 17, the Yerevan court of first instance, chaired by Judge Anna Danibekyan, rejected the lawyer's request. After that, the lawyers of the second president filed another motion to change Kocharyan's preventive measure, insisting on the release of Robert Kocharyan on bail. The court retired to the meeting, promising to make the decision public on Friday.
