A report was sent from the Kotayk Oblast Prosecutor's Office to the Kotayk Regional Investigation Department of the Investigative Committee of the Republic of Armenia on the basis of an audit conducted in the Hrazdan City Hall, according to which the head of the local government did not organize the legitimate acceptance of property tax payments, and the head of the relevant unit did not provide full input through his property tax workers to the community budget.
In fact, on November 1, 2018, a criminal case was opened on the grounds of part 2 of article 308, part 2 of article 315 and paragraph 1 of part 3 of article 179 of the RA Criminal Code, a preliminary investigation of which was carried out in the investigation department of Charentsavan of the IC of the RA.
The evidence obtained by an objective, complete and comprehensive investigation carried out under proper prosecutorial control proved that in 2015, from November 19 to November 21, a criminal corruption scheme operated with the involvement of numerous officials in the city of Hrazdan, through which a part of the sums was assigned, collected through land tax and property tax, in especially large amounts.
In particular, it was substantiated that the employees of the tax department of the Hrazdan Municipality apparatus from 2015 to 2018. when receiving property tax from the townspeople in one of the copies of the payment, the real amount of the tax was entered, in the other, which was intended for the mayor's office and the State Revenue Committee, a smaller one. As a result, it was collected, but more than 138 million drams were not received in the budget of the Hrazdan administration.
The employees of the tax department of the city hall handed over the funds collected but not directed to the city budget, the head of the department, the latter personally or through his management informed the head of the Hrazdan community Aram Danielyan about the amount of money collected from him. The latter indicated to the head or deputy of the tax department how much should be paid into the community budget, and the remaining parts were distributed among individual employees of the mayor's office or transferred personally to Danielyan. As a result, the former mayor of Hrazdan received a total of more than 102 million drams from taxes collected as a land tax and property tax, and stole those funds by appropriation, inflicting property damage on a particularly large scale to the Hrazdan community.
On the basis of a sufficient combination of the evidence obtained, Danielyan is accused on the grounds of clause 1 part 3 of article 179 of the Criminal Code of the Republic of Armenia.
The former head and deputy tax department of the mayor's office was charged on the grounds of clause 1 of part 3 of article 179 and clause 1 of part 3 of article 38-179 of the RA Criminal Code, and 6 employees of the same department - according to clause 1 of part 3 of article 179 of the RA Criminal Code, or paragraphs 2 and 3 of part 2 of the same article. As a preventive measure, a recognizance not to leave was applied to all.
The case against 9 people was sent to the court of first instance of general jurisdiction of the Kotayk region.
