ArmInfo. Civil confiscation proceedings in the amount of up to 2 million drams will be simplified in Armenia. The Armenian Parliament at an extraordinary meeting on July 1 in the second and final reading amended the Code of Civil Procedure.
Presenting the draft amendments, RA First Deputy Minister of Justice Artak Asatryan informed that by the second reading there were no proposals from the lawmakers. Referring to statistics, he pointed out that in 2003-2017 unprecedented increase has been recorded in court cases by courts of general jurisdiction for the confiscation of property - from 48,540 to 137,003. 80% of them concerned the confiscation of property, the value of which does not exceed 2 million drams. The deputy head of the Ministry of Justice recalled that as early as in February 2018, the new Civil Procedure Code established a number of procedures that were intended for a separate category of lawsuits to be considered in a simplified manner. The new initiative of the Ministry of Justice concerns the expansion of the list of cases to be considered in a simplified manner. In particular, it is proposed to establish that the consideration by courts in a simplified procedure of claims in the amount of not more than 200 times the minimum wage (2 million drams) can be applied from the moment the claim is filed. The document also regulates issues related to the exchange rate at the time of the application. The list of cases considered in the simplified procedure is also expanded to include a provision stating that the court proceedings can be considered in an expedited manner if there is no objection from the claimant.
