The Constitutional Court of Armenia extended the period of preliminary examination of the application of David Grigoryan, a Judge of the court of general jurisdiction of Yerevan, to suspend the proceedings on the case of the second President of Armenia Robert Kocharyan and other former high-ranking officials. Head of the Office of the Constitutional Court of Armenia Edgar Ghazaryan announced this.
Head of the Constitutional Court Hrayr Tovmasyan, guided by paragraph 29 of the Rules of Procedure of the Constitutional Court, decided to extend until July 9, 2019 the period of preliminary examination of the application of the court of general jurisdiction of the first instance of Yerevan, received by the Constitutional Court on May 20, 2019.
To note, David Grigoryan, a Judge of the court of general jurisdiction in Yerevan, who is in charge of the case on March 1, 2008, suspended the trial and sent the case to the Constitutional Court to study the legality of applying Article 301 to the second President of the Republic of Armenia Robert Kocharyan, who is accused of overthrowing the constitutional building.
The fact is that in 2008, Article 301 of the RA Criminal Code did not function; it was developed and adopted subsequently. And famously, the law is not retroactive, so the Judge decided to verify the validity of the application of this article in relation to Kocharyan.
