The Court of General Jurisdiction in Yerevan rejected the complaint of lawyers about the termination of the criminal prosecution of the 2nd President of Armenia Robert Kocharyan on the basis of his immunity. Yesterday the Court of Appeal rejected the petition of Kocharyan's defense to revise the decision of the court of general jurisdiction to arrest the second president.
To recall, on July 26, 2018, in the framework of the preliminary investigation of the criminal case on the events of March 1-2, 2008, former President of Armenia Robert Kocharyan was charged under the first part of Article No. 300.1 of the Armenian Criminal Code (an attempt to overthrow the Constitutional order on March 1, 2008). On the same day, a petition was submitted to the Yerevan Court of General Jurisdiction to elect arrest as a measure of restraint against Robert Kocharyan. However, on August 13, the Court of Appeal issued a decision on the release of Kocharyan on the basis of the immunity of the second president. After that, the verdict was appealed to the Court of Cassation, from where it was again sent to the Court of Appeal. On December 7, the Court of Appeal decided to arrest Kocharyan. Special Investigation Service of Armenia on March 13 of this year sent a petition to the court to extend the term of the arrest of the second president Robert Kocharyan for two months. On March 15, the court of first instance granted the prosecution's request to extend Kocharian's arrest.
