ArmInfo.Robert Kocharyan's lawyers intend to file a complaint with the Constitutional Court regarding several laws that were applied by the Court of Cassation against the second president of Armenia. The lawyer of Kocharyan Hayk Alumyan stated this in an interview with ArmInfo correspondent.
"We believe that these laws, in their interpretation applied to Robert Kocharyan, are unconstitutional. In particular, the matter concerns the repeal by the Court of Cassation of the decision of the Court of Appeal to change the measure of restraint against Kocharyan and refer the case to the Appeal Court ", stressed Alumyan.
He also noted that today there are 2 complaints to the European Court of Human Rights (ECHR-Ed. note). One of them concerns the arrest by the Court of Appeal of Robert Kocharyan, and the second complaint, filed back in October, concerns a violation of the right to Kocharyan's defense, as well as a violation of the presumption of innocence.
Alumyan also noted that there is also one complaint in the Court of Cassation, in which the lawyers intend to appeal against the measure of restraint in the form of an arrest, elected in respect of the second President of Armenia. Another complaint is in the court of general jurisdiction of Yerevan, about the release of the second president of Armenia on bail.
As for the new aspects in protection of Robert Kocharyan, the lawyer noted that in a few days the defense intends to file several petitions to the investigator regarding various facts brought against Kocharyan. "We believe that these facts do not correspond to reality, they are contrived," Alumyan said. To note, on December 7, the Criminal Court of Appeal of Armenia rejected the petitions of the team of lawyers of the second President of Armenia, Robert Kocharyan, leaving unchanged the decision of the court of first instance on the election of a measure of restraint in the form of detention. After receiving a copy of the Decision of the Court of Appeal on December 7, the attorneys of the second President of Armenia Robert Kochar<an stated that they would appeal the decision of the Court of Appeal to the Court of Cassation.
To recall, on December 28 the court of general jurisdiction of Yerevan postponed consideration of the petition of the lawyers of the former president of Armenia Robert Kocharyan for release on bail to January 9, 2019.
