The member of the Republican Party of Armenia, ex-Minister of Justice David Harutyunyan is extremely concerned about the fact of the criminal prosecution of the second president Robert Kocharyan. In addition, the ex-minister thinks, the petition for the arrest of the ex- president of Armenia is devoid of legal language. He said this on July 27 in an interview with reporters.
In particular, according to Harutyunyan, if there were serious legal arguments, they should have also been presented in a press release that did not contain legal elements. "I see the wrong interpretation of the law, for example, it says that the army can be used for security issues, and I at least had the impression that the authors of the material assume that security concerns only external threats. a little deeper into the law, and it will be clear that security has both external and internal components and, in this sense, the use of the army is permissible in such situations, "he said.
As pointed out by the former head of the Ministry of Justice, for any lawyer it is not problematic to get acquainted with the law "On the Legal Regime of the State of Emergency" adopted in 2012, which also provides for the possibility of using the Armed Forces in a state of emergency. The law, as Harutyunyan noted, received a positive conclusion from the Venice Commission of the PACE, moreover, in exactly a number of European countries, the same procedure operates exactly. At the same time, the Constitution, including the current one, prohibits the prosecution of the president for actions stemming from his authority - even after he leaves the presidency. "It's another matter if these actions are committed outside of the authorities, which was not," he stressed. In addition, according to Harutyunyan, at that time the situation was such that when the announcement of a state of emergency could lead to additional casualties.
As for the very criminal prosecution and Robert Kocharyan's remarks that the process initiated against him is conditioned by the desire to neutralize his participation in political processes on the eve of the early parliamentary elections, then, according to David Harutyunyan, today's speech is not only about the second president , but also all military figures of Armenia, who for many years had a clear and unswerving position in the Karabakh issue. "I see a certain tendency, namely, that it is these persons who are primarily charged, and this also worries me," he said.
