ArmInfo. The Special Investigation Service gives another chance to ex- President of Armenia Robert Kocharyan to appear in the investigative body for questioning. In the opposite case, referring to the Criminal Procedural Code of the Republic of Armenia, the head of the department Sasun Khachatryan promises to apply procedural coercion measures in his respect.
Khachatryan said this on July 10 in an interview with reporters In particular, as Khachatryan pointed out, the Armenian Criminal Procedure Code clearly regulates the procedures for calling and conducting questioning. A witness who did not come to the interrogation for a valid reason must inform the body that is carrying out the production in advance. Otherwise, it is subject to compulsory enforcement.
In this case, according to Sasun Khachatryan, Kocharyan did not inform the SIS about valid reasons for non-appearance in the investigative body. The office of the second president limited itself only saying that Robert Kocharyan is abroad and will be in Armenia not earlier than July 25. "Taking into account the personality of the ex-president, at this stage, the SIS did not make a decision on the forced detention. Questioning invitation was sent to Kocharyan again today and was asked to appear in the SIS as a witness on the criminal case already on July 26," explained the head of the department.
This time, Robert Kocharyan, as the head of the investigative body pointed out, in case of failure to appear for valid reasons is obliged to inform in advance about this, otherwise the SISS will apply the measures of procedural coercion. According to the SIS head, it is possible that the ex-president had good reasons to not appear in the investigative body the previous time, but did not know that he should inform the investigating body about this. "I hope at the appointed time Robert Kocharyan will come for questioning," he said, while abstaining will answer the question whether a search for the 2 nd president will be announced if he does not come for an interrogation.
