ArmInfo.The deputy head of the Armenian Defense Ministry's administration was arrested for bribing in the case for deliveries of material resources for the needs of the department. He is accused of taking bribes on an especially large scale.
As the press service of the Prosecutor General's Office of Armenia reports, Yerevan resident A. A. - the founder and director of "AA" LLC applied to the department with a statement, followed by a message and an explanation to the Office for especially important cases of the Investigation Committee of the Republic of Armenia that from 2008 to 2013 the deputy head of the Office of the Ministry of Defense of the Republic, M. Kh., at that time the chairman of the Commission on receipt of material resources supplied by the company to the needs of the defense ministry, to take action in favor of the supplier, annually, when accepting goods within the framework of concluded contracts, required and received a bribe from him in the amount of 5 to 7% of the price of the concluded Contract, as a result, as a whole, received the amount of 29.220.000 AMD.
In connection with the incident, a criminal case was opened on the basis of clauses 2, 4, art. 311 of the RA Criminal Code (Receipt of a bribe in person or through an intermediary in the form of money, property, right to property, securities or other property benefits for the commission or non-performance of any action by an official within the scope of his authority in favor of the bribe-taker or the person he represents, for facilitating the commission or failure of such an act or for patronage or connivance in the service using his official position - the acts provided for by the first, or second, or third parts of this article are committed in particularly large amounts) and p. 1, part 3, art. 312-th (bribery, committed in especially large amounts).
During the preliminary investigation it became clear that M.Kh. on the day unexplained by the investigation, appearing at the LLC, said that he would further deal with the delivery of furniture for the needs of the Defense Ministry and offered his services, valuing them at a rate of 7% of the price stipulated in the supply contract. The parties reached an agreement, which they adhered to until 2013. In exchange, M.Kh. undertook, within the limits of his powers, to identify nonconformities declared by the technical characteristics of the tender during the acceptance of the goods, to take it instead of returning them.
"On February 6, 2018, M. Kh. was charged with 2, part 4, art.311 of the Criminal Code of the Republic of Armenia (Taking a bribe, an act committed on a particularly large scale.) The latter does not plead guilty," the Prosecutor General's Office said. However, on the same day, the investigator conducting the proceedings decided to select detention as a preventive measure, which was rejected by a decision of the Court of General Jurisdiction. "The public prosecutor overseeing the legality of the preliminary investigation in the criminal case filed an appeal against the decision of the Court on February 20, 2018. On March 15, 2018 the appeal was granted by the Court of Appeal, the judicial act of the court of general jurisdiction was abolished, and in relation to M.Kh. As a measure of restraint, detention was selected, "the press service of the Prosecutor General's Office reported. The preliminary investigation is continuing.
