հեղինակային և հարակից իրավունքների պաշտպանության հետ: Հերթական անգամ կոնֆլիկտի
էպիկենտրոնում է հայտնվել ՀՀ նախկին վարչապետ և ներկայումս ՀՀ ԱԺ պատգամավոր Հրանտ
Բագրատյանը, ում մեղադրում են գրագողության մեջ:


 


Նշենք, որ
գիտնական Մանե Հակոբյանը մշակել էր «ՀՀ գիտության և կրթության ոլորտի համակարգային
բարեփոխումների և կայուն զարգացման ծրագիր», որը գրանցել էր հեղինակային
իրավունքների պաշտպանության «Հայհեղինակ» գործակալությունում, իսկ երկու տարի առաջ
այն հրապարակել էր նաև «Հետք» թերթի երկու համարներում: Ծրագրի դրույքները, ըստ
հայցվորների, յուրացրել է նախկին վարչապետ Հրանտ Բագրատյանը: Հայցում ասված է, որ
«պատասխանողներ Հրանտ Բագրատյանը և Հարություն Կարապետյանը յուրացրել են Մանե
Հակոբյանի ծրագրի գիտությանը վերաբերվող բաժինը, անբարեխիղճ ձևով վերահրատարակել
այն, չհիշատակելով իսկական հեղինակին, աշխատանքը ներկայացնելով իրենց անուններով,
այնուհետև հրատարակել են մեծ տիրաժով` առանց հեղինակի թույլտվության, միաժամանակ,
առանց նրան որևէ փոխհատուցում վճարելու»:


 


Ինչպես դեկտեմբերի
17-ին Երևանում կայացած մամուլի ասոլիսում հաղորդել է  Մանե Հակոբյանի հեղինակային իրավուքների
պաշտպանության գործերով փաստաբան Սեդրակ Ասատրյանը, Մանե Հակոբյանի
արդարացիությունն այնքան ակնհայտ է, որ բազմաթիվ փաստեր դատական գործընթացի
ընթացքում ապացուցվեցին: «Բագրատյանի կողմից ներկայացված ոչ մի փաստարկ
չհաստատվեց, իսկ հակընդեմ հայցի բավարարման մասին նույնիսկ խոսք անգամ լինել չի
կարող»,-նշել է նա:


 


Պատասխանելով այն
հարցին, որ ՀՀ արդարադատության փոխնախարար Արամ Օրբելյանը, Ասատրյանի
«Կոնցեռն-Դիալոգ» իրավաբանական գործակալությունում ունենալով 25% բաժնեմաս, կարող
էր իր պաշտոնական դիրքն օգտագործել դատարանի վրա ճնշումներրծադրելու համար,
Ասատրյանը հավաստել է, որ դա աբսուդ է, քանի որ Օրբելյանը միայն դիվիդենտներ է
ստանում և գրասենյակի գործունեությանը չի խառնվում: Իսկ 2011 թվականի օգոստոսի
7-ին Ֆեյսբուքյան էջում պատասխանողները հրապարակեցին «ՀՀ գիտության ոլորտի
համակարգային բարեփոխումները» անվանումով աշխատանքը, որը հայցվորը գնահատեց որպես
գրագողություն: Համաձայն դատավճռի եզրափակիչ մասի, պատասխանողները պարտավոր են ֆեյսբուքյան
էջից դուրս հանել նշված հրապարակումը:


 


Հիշեցնենք, որ
Երևանի Արաբկիր և Քանաքեռ-Զեյթուն համայնքների ընդհանուր իրավասության դատարանի
դատավոր Սիմիզար Հովսեփյանը հրապարակեց Մանե Հակոբյանի իրավունքների խախտման
վերաբերյալ հայցով դատավճռի եզրափակիչ մասը: Դատարանը բավարարեց հայցվորի պահանջը,
իսկ հակընդեմ հայցը մերժվեց:


 


Նշենք նաև, որ
ավելի վաղ «Այլընտրանք» վերլուծական կենտրոնի ղեկավար Թաթուլ Մանասերյանը նույնպես
Հրանտ Բագրատյանին մեղադրել էր գրագողության մեջ:
