According to the Prosecutor General's Office, a criminal case has been opened regarding the armed incident involving "citizen of the Republic of Azerbaijan, serviceman Nasimi Musayev" under Article 166, Part 2, Clause 6, Article 335, Part 1, and Article 207, Part 1 of the Criminal Code. However, miraculously, the criminal case does not include an article on illegal border crossing.
According to the Armenian Criminal Code, Article 166, Part 2, Clause 6 defines causing grievous bodily harm committed with the use of a weapon or an object or means prepared or adapted in advance to cause bodily harm. And part 1 of Article 335 - the illegal acquisition, sale, storage, transportation, transfer or carrying of firearms (with the exception of civilian smooth-bore firearms, cartridges for them or their component parts), their main component parts, ammunition, cartridges for rifled firearms, explosives or explosive devices - is punishable by restriction of liberty for a term of up to three years, or short-term imprisonment for a term of up to two months, or imprisonment for a term of up to five years; And Part 1 of Article 207—illegally entering a person's home against their will or disregarding their will—is punishable by a fine of up to twenty times the fine, or community service for eighty to one hundred and fifty hours, or restriction of liberty for up to two years, or short-term imprisonment for up to two months, or imprisonment for up to two years.
The Prosecutor General's Office did not explain how it came about that the case does not include evidence of illegal detention of the Republic of Armenia.
It should be noted that the news of an Azerbaijani serviceman entering the home of a resident of the village of Shake in the Syunik region became known on the afternoon of October 1. A statement from the National Security Service of Armenia revealed that Armenian and Azerbaijani authorities had been searching for the serviceman in question since September 29, although no security outreach had been conducted, and residents of the region were kept in the dark.
