As noted in a statement by the ANC to ArmInfo, the Constitutional Court, formed by illegal criminal means, is one of the key factors threatening democracy and internal stability in post-revolutionary Armenia. Serving the interests of the former regime, which repeatedly violated the constitutional order and impeded the administration of justice, it became a source of constitutional violations and a constant source of tension. The problem of forming the Constitutional Court, with the confidence of the people, must be solved. Without this, it is impossible to build a democratic country.
As the authors of the statement note, many of the provisions of the current constitution, which are imposed on the people through widespread falsification, are and will always cause legal deadlocks, and lead to conflicting comments. "This issue will be resolved by the citizens of Armenia in a referendum. The task of the government is to guarantee complete, non-negotiable conditions for the free expression of the will of the people," the document says.
Congress also regrets that the government did not respond to numerous calls by political forces and public figures and was unable to resolve this important issue in time - a year ago. "In the end finally, lethargy and lack of resolve in this matter led to unnecessary complications. We also express disappointment that the agenda of the referendum includes a question directly related to constitutional law, in particular, the existence of an unreasonable and absurd function of the unlimited right of the Constitutional Court to block decisions made. It is no coincidence that such a provision was absent in the 1995 Constitution. It is not enshrined in the laws of democratic countries. Considering the formation of the Constitutional Court as a necessary prerequisite for resolving the current political crisis, the Armenian National Congress supports the constitutional amendment proposed by the National Assembly and will actively participate in the referendum, "the ANC statement says.
