ArmInfo. After the constitutional reforms of 2015, the Constitutional Court of Armenia acts inadequately. This was announced on January 29 during a briefing in the National Assembly of Armenia by head of the "My Step" faction Lilit Makunts. She noted that the crisis around the Constitutional Court was caused not only by a lack of trust in the judicial system, but also by the fact that the transitional provisions, which should be transferred from the old Constitution to the new, have drawbacks.
The MP also stressed that the bill on early retirement of judges of the Constitutional Court is an opportunity to resolve the crisis in the Constitutional Court. "We came up with this legislative initiative based solely on the interests of judges of the Constitutional Court. Perhaps some of them will not want to continue to work and prefer to retire. However, as you know, there is no problem with coercion. If the judges of the Constitutional Court do not see any problems, and want to continue to work, no one forces them to do otherwise, "said the head of the My Step faction.
In turn, the secretary from the Prosperous Armenia faction Arman Abovyan stated that their faction does not see the need for the authorities to constantly raising this issue. "We have noted more than once that we see much more important problems in the country than this. The fact is that the current government is trying to get rid of the head of the Constitutional Court at all costs. It was for this purpose that the legislative initiative on early retirement of Constitutional Court judges was adopted . If this venture fails, I do not exclude that they will try to use other methods to solve this issue, "the MPconcluded.
Taron Simonyan, a member of the Bright Armenia faction, expressed surprise at the fact that the authorities speak of distrust of the entire judicial system, but only judges of the Constitutional Court are constantly under attack. "Of course, the public does not trust the judiciary. And it's obvious that in a number of cases the public is right, because the judicial system cannot provide effective justice. However, the Constitutional Court is not to blame for this situation, the problem is in the entire judicial system. All this is forgotten and the problem focuses on one person, which is wrong, "the MPemphasized.
Simonyan also emphasized that there should be a strict delineation of the branches of power in the country, and one of the branches has no right to exert pressure on the other. "We have written in the Constitution about the mechanisms of restraining a branch of power that is trying to put pressure on another branch. However, if this mechanism fails, then a serious problem arises, and the situation goes beyond the scope of the Constitution. In this case, it turns out that pressure on the Constitutional Court it's quite the place to be, "the deputy concluded.
To note, the current authorities have repeatedly stated that a crisis has arisen in the Constitutional Court. They believe that in order to solve this crisis, judges of the Constitutional Court, headed by the chairman Hrayr Tovmasyan, should resign. To this end, the legislature passed a law stating that judges of the Constitutional Court can retire ahead of schedule, if they do, then until the end of their term of office they will receive a pension in the amount of their salary. Judges disagree with this assessment, and so far do not intend to resign.
