Ակտիվիստները Գլխավոր դատախազությանը կոչ են անում ուսումնասիրել Սյունիքի մարզում վերամշակման ֆաբրիկայի ապօրինի շինարարության հետ կապված իրավիճակը

Համահայկական բնապահպանական ճակատը (ՀԲՃ) ՀՀ գլխավոր դատախազությանը և ՀՀ հատուկ քննչական ծառայությանը կոչ է անում ուսումնասիրել Սյունիքի մարզի Տաշտուն համայնքում վերամշակման ֆաբրիկայի ապօրինի շինարարության հետ կապված իրավիճակը: 


ՙՀունիսի 29-ին Համահայկական բնապահպանական ճակատը (ՀԲՃ) ՀՀ պետական լիազոր մարմիններին տեղեկացրել էր Սյունիքի մարզի Տաշտուն համայնքում ՙԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ի կողմից իրականացվող ապօրինի շինարարության մասին, ինչը հետագայում պաշտոնապես հաստատեցին ՀՀ քաղաքաշինության և բնապահպանության նախարարությունները: Բնապահպանության նախարարության աշխատակազմի բնապահպանական տեսչության Սյունիքի բաժնի կողմից տեղում կատարված ուսումնասիրության արդյունքներով դադարեցվել է գործարանի կառուցման գործընթացը: Իսկ Քաղաքաշինության նախարարությունից մեզ պաշտոնապես պատասխանել են, որ մեր ահազանգի հիման վրա կատարված ուսումնասիրությունների արդյունքում պարզել են, որ ՙԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ն առանց քաղաքաշինական և իրավական փաստաթղթերի ձևակերպման, փաստորեն՝ ինքնակամ, իրականացնում է բետոնապատման և հողային աշխատանքներ։ Իրենց կողմից 2013թ. հուլիսի 12-ին Տաշտուն համայնքի ղեկավարին ուղարկվել է գրություն, որով առաջարկվել է կասեցնել ինքնակամ իրականացվող շինարարությունը և միջոցներ ձեռնարկել հետևանքների վերացման ուղղությամբ։ Ոստիկանության Մեղրիի բաժնից էլ մեզ տեղեկացրել են, որ այդ դեպքի վերաբերյալ նախապատրաստվել են նյութեր, որոնք 29.07.2013թ. ուղարկվել են Սյունիքի մարզի քննչական բաժին հետագա ընթացքը որոշելու համար: Սակայն այս ամենից հետո պարզվում է, որ շինարարական աշխատանքներն ամենևին էլ դադարեցված չեն, իսկ Տաշտուն համայնքի ղեկավարը և ՙԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ի պատասխանատուները թքած ունեն օրենքների ու նախարարությունների որոշումների վրա: Այս ամենի մասին ս. թ. օգոստոսի 13-ին հաղորդում ենք ներկայացրել ՀՀ ոստիկանություն և գլխավոր դատախազություն՝ կցելով նաև համապատասխան նյութերը: Դատախազությունից մեզ տեղեկացրել են, որ նյութերը քննարկման նպատակով ուղարկվել են Սյունիքի մարզի դատախազին: Մինչ պետական և իրավապահ մարմինները քայլեր ձեռնարկելու իմիտացիա են ստեղծում՝ հանցագործությունը շարունակվում է... ՙ


ԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ն շարունակում է անօրինական շինարարությունը, իսկ Հայաստանի Հանրապետություն թերթի 27.07.2013թ. թիվ 140 (5710) համարում տեղադրվել է Տաշտուն համայնքի գյուղապետ Հ. Գաբրիելյանի հայտարարությունը համայնքային սեփականություն հանդիսացող հողերի աճուրդ-վաճառքի վերաբերյալ: Համաձայն հայտարարության` աճուրդային կարգով վաճառվում է 2,155 հա հողամաս արդյունաբերության օբյեկտի՝ ֆաբրիկայի կառուցման համար: Սա թույլ է տալիս մեզ արձանագրելու, որ Տաշտուն համայնքի ղեկավարը, պետական մարմինների հանձնարարականները կատարելու փոխարեն, հանցավոր համաձայնության գալով ՙԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ի տնօրինության հետ, փորձում է աջակցել նրան` ձեռք բերելու այն հողամասը, որտեղ արդեն իսկ վերջինիս կողմից կատարվել և կատարվում են ապօրինի շինարարական աշխատանքներ: Սրանով նրանք երկուսն էլ փորձում են կոծկել հանցագործությունը և խուսափել պատասխանատվությունից, սակայն դա նրանց չի հաջողվի: Ի դեպ, իրավապահ մարմինների ուշադրությունն ենք ցանկանում հրավիրել մի շատ կարևոր հանգամանքի վրա. պետք է հետաքննություն իրականացնել և պարզել սույն աճուրդի անցկացման մասին արված հայտարարության իրավական հիմնավորումները, մասնավորապես՝ թե Տաշտունի գյուղապետն ինչ հիմքերով է աճուրդի հանել մի հողատարածք, որտեղ արդեն չորս ամիս է ՙԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ի կողմից հարստացուցիչ ֆաբրիկայի շինարարություն է իրականացվում՝ առանց շինարարության թույլտվության և բնապահպանական փորձաքնության եզրակացության: Մենք համոզված ենք, որ այս աճուրդի հայտարարությունն ու անցկացումը իմիտացիա է. արդեն իսկ պարզ է` ով է լինելու աճուրդի հաղթողը: Բոլորս, այդ թվում նաև դուք, տեղյակ ենք, թե աճուրդներն ու մրցույթներն ինչպես ու ինչ ընթացակարգով են անցկացվում մեր հանրապետությունում` ձևական մասնակիցներ են ներգրավվում, և հաղթում է այն ընկերությունը կամ անձը, ում համար իրականում անցկացվում է այդ աճուրդը: Ի վերջո, ՀՀ գլխավոր դատախազությունն ու ՀՀ հատուկ քննչական ծառայությունը կարո՞ղ են ՇՐՋԱԿԱ ՄԻՋԱՎԱՅՐԻ ԱՆՎՏԱՆԳՈՒԹՅԱՆ ԴԵՄ ՈՒՂՂՎԱԾ ՀԱՆՑԱԳՈՐԾՈՒԹՅՈՒՆՆԵՐՆ ըստ էության բացահայտել և օրինախախտ ընկերություններին ու համայնքների ղեկավարներին քրեական պատասխանատվության ենթարկել: Մեր փորձը ցույց է տալիս, որ այս և բնապահպանական ոլորտի այլ հանցանքների մասին մեր հաղորդումները կամ մնում են անպատասխան, կամ այդ կառույցներից ստացվում են այնպիսի բովանդակության պատասխաններ, որոնք ըստ էության ոչինչ չեն նշանակում: Այսպիսով, ելնելով վերոշարադրյալից, պահանջում ենք ՀՀ գլխավոր դատախազությունից ու ՀՀ հատուկ քննչական ծառայությունից անհապաղ քայլեր ձեռնարկել հայտարարված աճուրդի անցկացումը կասեցնելու և մեղավոր անձանց պատասխանատվության կանչելու ուղղությամբ: Ի՞նչ աճուրդի մասին կարող է խոսք լինել, երբ կատարվել է հանցագործություն Տաշտունի գյուղապետի և ՙԱՏ-ՄԵՏԱԼՍ՚ ՍՊԸ-ի պատասխանատուների կողմից, ինչին մինչ օրս իրավական գնահատական չի տրվել իրավապահ մարմինների կողմից: Պետք է անհապաղ կասեցնել հայտարարված աճուրդը, այնուհետև՝ քրեական գործ հարուցել և այս օրինախախտ սուբյեկտներին կանչել պատասխանատվության: Ակնկալում ենք սեղմ ժամկետում ստանալ Ձեր գործուն միջամտությունն ու արձագանքը սույն հաղորդման վերաբերյալ՚,-ասվում է ՀԲՃ հաղորդագրության մեջ:
