ArmInfo. Based on the application of the Defender of Human Rights, the Constitutional Court declared illegal the deprivation of detainees and convicts of mechanical means of communication with the outside world, as provided for by law.
The Constitutional Court set a deadline for the National Assembly and the government until June 5, 2019, giving the opportunity to make adjustments to the controversial provisions otherwise they will expire.
The court's decision established that the controversial regulations contradict those articles of the Constitution, which guarantee the right to privacy and family life, the right to free communication, and the principle of proportionality.
In a statement addressed to the Constitutional Court, the Defender of Human Rights made the RA law "On the custody of arrested and convicted persons" and some provisions of the internal regulations on the maintenance of convicted persons in correctional institutions decided by the Government to be a subject of dispute.
The statement of the Human Rights Defender states that under such conditions it turns out that this punishment has the nature of causing additional deprivations that have nothing to do with the goals of the punishment or its causes. In these conditions, an individual approach is also not carried out, and risk factors are not evaluated. The Constitutional Court confirmed the position of the Defender that the additional restrictions imposed on the detainees should be directly related to the violation, and the restriction of rights and freedoms should be lawful. The Constitutional Court also took into account the experience and practice of international and human rights organizations in the matter of the custody of arrested persons and prisoners and their right to communicate with the outside world.
