ArmInfo.The court of general instance today at 5:30 pm will make public the decision on the measure of restraint against the second President of Armenia, Robert Kocharyan, who is accused of overthrowing the constitutional order.
As the former president's lawyers group recalls, the court simultaneously considered two petitions - filed by the defense and the prosecution (Special Investigative Service): to apply an alternative preventive measure against Kocharyan - release on bail, and also to extend his arrest for two months. On December 16, the investigator of the Special Investigation Service (SIS) of the Republic of Armenia rejected the request of the defense team of January 9 to stop the criminal prosecution against the second President of Armenia, Robert Kocharyan. According to lawyers for Robert Kocharyan, the rejection of the petition was motivated by the fact that the accusation was based on sufficient evidence obtained in accordance with the law, and there are no circumstances precluding criminal prosecution. Meanwhile, Kocharyan's defense believes that the retired president cannot be accused under the article "overthrowing the constitutional order" in the case of the events of 2008, because at that time there was no such article and corpus delicti foreseen by it in the Armenian Criminal Code.
