ArmInfo.The Armenian Criminal Court of Appeal changed the measure of restraint against Robert Kocharyan. Thus, the court granted the motion of the 2 nd RA President to change the measure of restraint in the form of arrest, even without applying the bail offered earlier by the defense.
As one of Kocharyan's lawyers, Ruben Sahakyan, stated in a conversation with journalists, the Armenian 2 nd president was released by the decision of the Court of Appeal, taking into account his immunity. The main thesis of this provision in both the previous and the current Constitution, states that the President of the Republic is inviolable - the President of the Republic of Armenia during his term of office and after that can not be prosecuted and held accountable for actions arising from his status. In this context, as the lawyer stated, the decision of the court of first instance was unconstitutional. At the same time, according to Sahakyan, Robert Kocharyan continues to remain in the status of the accused.
To note a few days ago responding to the journalists' request to comment on the charge brought against Armenia's second President Robert Kocharyan, his detention and statements by his supporters about political persecution against him, Armenian Prime Minister Nikol Pashinyan stated that at this stage of legal processes, he would refrain from commenting on this issue. "I think it's wrong at the moment to give any comments on this topic, since any comment can be considered, interpreted as interference, influence on the case, but I believe that all of you and every citizen of Armenia have an answer to this question, "Pashinyan said. To recall, the second president of Armenia Robert Kocharyan was imprisoned on July 28. He is charged under art. 300.1 of the Armenian Criminal Code in overthrowing the constitutional order in the framework of the criminal case on dispersal of protest actions on March 1, 2008. Kocharyan himself even before the arrest called the charges against him a political persecution. According to him, this is a "vendetta" under the slogan of love and solidarity of "velvet revolution."
