ArmInfo. The party of defense of the CSTO Secretary General Yuri Khachaturov filed an appeal against the actions of the court of general jurisdiction. The lawyer of Khachaturov Mihran Poghosyan told journalists about it.
According to Poghosyan, at this stage, the pledge is an alternative to arrest, that is, the court found that the arrest against Yuri Khachaturov is permissible. In the legal field, he explained, the following principle operates: for the admissibility of arrest, it is necessary to justify the charge, only then the grounds for the arrest are discussed. In the case of Khachaturov, as the lawyer clarified, the court found it justified that the CSTO secretary general has nothing to do with the accusation, that is, he did not take any actions aimed at overthrowing the constitutional order. Given this circumstance, the court nevertheless decided that the arrest is permissible. "We consider that in these conditions the arrest is not permissible and on this basis submitted a complaint to the Court of Appeal and ask the court to cancel the decision of the court of first instance and cancel the decision on the arrest," said Mihran Poghosyan.
According to Poghosyan, Yuri Khachaturov a week earlier - on August 4 he returned to his duties as CSTO Secretary General. It is not known yet when he will return to Armenia.
On August 2 the Special Investigative Service stated that the preventive measure chosen against Yuri Khachaturov is not an obstacle for him to absent himself from Armenia for some time. At the same time, the CAS did not detail the permissible period of its absence. Recall that Khachaturov is accused of overthrowing the constitutional system in the so-called "case on March 1, 2008". At that time he held the post of the head of the Yerevan garrison. By a court decision of July 28, he was arrested and then released on bail in the amount of 5 million drams. The second case is being held by the second Armenian President Robert Kocharian, who is currently under arrest for two months and former defense chief Mikael Harutyunyan, who was put on the wanted list.
